A Lubbock grand jury indicted Justo Mendez Jr., 37, on Tuesday. He is charged with aggravated assault against a family member with a deadly weapon, causing serious bodily injury. KCBD reported that the indictment comes after his father died in September.
Police said Mendez Jr. got into what he told officers was a "bad fight" with his father at a home near 64th Street and Avenue S on the morning of Sept. 27. Police said he had taken about 50 Xanax pills before the fight. A witness told police they saw a "black steel pry bar" leaning against a couch in the living room and said it appeared to have blood on it.
Mendez Jr. is being held in the Lubbock County Detention Center on a $500,000 bond.
