Harris County District Attorney Sean Teare and Sheriff Ed Gonzalez said they would hold a morning press conference to announce an indictment in the case. Miguel Parra-Hernandez was run over by an ICE-driven SUV on Oct. 10.
Video shows Parra-Hernandez getting out of a pickup truck and running from an agent, who appears to turn and hit him, according to the report. ICE said Parra-Hernandez was not its target and alleged that a second man in the vehicle was. Attorneys for Parra-Hernandez said ICE's actual target was not in his vehicle.
A search warrant obtained by ABC13 says prosecutors are looking for evidence to potentially charge the agent with two counts of aggravated assault and possibly reckless driving. Teare said ICE removed the agent's vehicle from the scene, so investigators could not examine it. He told ABC13 on Oct. 13 that "This was an intentional strike." A document attached to the warrant, dated Oct. 23, says ICE received the warrant but has not provided access to the vehicle. ABC13 has reached out to ICE for comment.
